Our Class of 2024 Hawks have the amazing opportunity to attend a seminar conducted by the DE State Police. All sophomores will attend in the lecture hall during their drivers education class. The purpose of this event is to explain basic legal rights and provide practical suggestions to inform students’ decision-making during a vehicular stop by law enforcement. This presentation clarifies common misunderstandings and allows new drivers the opportunity to understand common police practices. I. The Traffic Stop a. Proper Procedure and Safety i. Why officers do what they do ii. What you should do when pulled over (with an emphasis on understanding why they should do it) b. Common Issues/Questions i. Phone usage (calls and video) ii. Identification (including passengers) iii. Police directives to exit the vehicle II. Constitutional Rights and how to exercise them appropriately a. Free Speech and its implications b. Search and Seizure, Warrants and the Automobile c. Representation and Self-incrimination d. Title 11, Section 1902 detention statute III. Reporting violations of your rights a. How to address perceived violations of your rights i. When and where ii. Attention to details of the stop IV. Common impairments for young drivers a. Marijuana and alcohol b. Cell phones c. Passengers |
